Not filling a prescription would violate federal law.
The Department of Health and Human Services said Wednesday that pharmacies refusing to fill prescriptions for drugs that could be used to terminate a pregnancy would violate federal law, regardless of various state bans on the procedure.
Their “guidance,” which involves roughly 60,000 American retail pharmacies, comes days after President Biden signed an executive order ensuring access to services to terminate pregnancies after the Supreme Court’s ruling last month that overturned Roe v. Wade.
“We are committed to ensuring that everyone can access healthcare, free of discrimination,” HHS Secretary Xavier Becerra stated. “This includes access to prescription medications for reproductive health and other types of care.”
